Disgraced celebrity chef Matthew Tivy, who was jailed on charges that he had sex with underage boys, died in federal custody, his lawyer said Tuesday.
Tivy died Monday, succumbing to complications from a brain tumor, according to his lawyer, Glenn Hardy. Tivy, 55, was awaiting trial on charges that he had sex with a boy in a Bronx Best Buy parking lot, and was said to be negotiating a plea deal with prosecutors.
Hardy said Tivy, a television personality, had surgery about two weeks ago, but it was unclear if Tivy had cancer.
Tivy was pronounced dead at the New York Presbyterian Weill Cornell Medical Center, according to the federal bureau of prisons. An autopsy is pending.
“He seemed to have been recovering and then from what I understand,” Hardy said. “He lapsed into a coma.”
Before his arrest by federal agents, Tivy was out on bail on a similar state charge. According to Hardy, Tivy was “seeing a doctor trying to build up a record of him getting therapy to mitigate the situation and so that he could get the help that he perhaps needed.”
Prosecutors said Tivy had videotaped the at least two encounters.
Tivy, who owned the Upper West Side restaurant Café du Soleil, was charged in Oct. 2015 with sexual exploitation of a minor and having child pornography by federal prosecutors.

Months earlier Tivy was charged with several offenses, including third-degree sexual abuse, on charges of having sex with a 16-year-old boy.. He was also accused of swapping porn with other teenage boys.
U.S. Attorney Preet Bharara’s office declined to comment.
Tivy was also a defendant in a civil trial where he faced similar accusations.

The Culinary Institute of America grad had been dating 47-year-old opera singer Keith Jameson for more than a decade. . Previously, Tivy was married to a woman, Jen Mahon, for a short time in the early 1990s.
Jameson, posted a moving tribute on Facebook.
“We have lost our husband, son, brother, friend, colleague, band member, singer, chef extraordinaire and exceptional man,” Jameson wrote. “I am devastated and heartbroken. I loved this man with all my heart.”
